Shipping and Delivery Policy

1. Delivery Services:

The PND Services enable Users to connect with Delivery Partners and non-tied-up Merchants to complete tasks raised by such Users, including tasks to buy, pick up, and drop items (the "User Items") from non-tied-up Merchant locations ("Pick-Up Location") and to drop to another location ("Drop Location"), each of which is a "Delivery Task." It is expressly stated that Guzo does not take any duty or liability for any kind of service inadequacy on the part of the non-tied-up merchants or the delivery partner and just serves as a technology platform to facilitate delivery tasks launched on the platform.

Upon submitting a request for a delivery assignment, a delivery partner is assigned to that task based on their availability and acceptance. For user confirmation, the delivery partner must transmit images of the user items listed on the platform ("User Item Picture(s)") along with the relevant value. Before starting a payment, users are advised to carefully verify and confirm the items’ pictures. If a dispute arises between a user and the delivery partner, Guzo will rely on the user's confirmation of the item pictures. In the event that the user item picture(s) is different from the user item listed on the platform, users should immediately reach out to the assigned delivery partner and request that they share the correct user item picture(s). User approval of a user item picture is interpreted as acceptance of the amended or new user item.

 
2. By using the delivery services, users comprehend, concur, accept, and agree that:

·       The collaboration between Guzo and the delivery partners is on a principal-to-principal, non-exclusive, and voluntary basis. There is no employer-employee relationship between Guzo and the delivery partners, nor does Guzo have any influence over them.

·       An independent service contract between users and a delivery partner is created when a delivery task is accepted by a delivery partner.

·       Guzo is not liable if the delivery partners fail to complete a delivery task or violate one. Guzo makes no promises regarding the accomplishment of any delivery tasks started on the platform by users or delivery partners, respectively.

·       Guzo is neither a restaurant, a retail establishment, a delivery service for goods or food, a shipping or courier company, nor a company that prepares food. Guzo runs an online marketplace but does not have any ownership or other rights to the goods being transported as part of any delivery task at any point during any transaction.

·       The user has willingly uploaded the pick-up location and the drop location to the platform, and the user's location data is collected in line with the privacy policy and the terms of use.

·        Users are aware of the items to be transported through a Delivery Task, and that Delivery Tasks cannot be initiated, for item(s) which are illegal, hazardous, dangerous, or otherwise restricted or constitute items which are prohibited by any statute or law or regulation. Such items include, but are not limited to, radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates, gold and silver ore, bullion, precious metals and stones, jewellery, semi-precious stones including commercial carbons or industrial diamonds, currency (paper or coin) of any nationality, securities (including stocks and bonds, share certificates and blank signed share transfer forms), coupons, stamps, negotiable instruments in bearer form, cashier's cheques, travellers’ cheques, money orders, passports, credit/debit/ATM cards, antiques, works of art, lottery tickets and gambling devices, livestock, fish, insects, animals, plants and plant material, human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens, hazardous or bio-medical waste, wet ice, pornographic materials, contraband, bottled alcoholic beverages or any intoxicant or narcotics and psychotropic substances.

·       Delivery tasks cannot be created for the shipment of any goods that, in accordance with the legislation, require a particular transportation licence or authorization.

·       Delivery partners may notify the appropriate law enforcement authorities of any crime committed during a delivery task or of any plan to commit a crime upon becoming aware of such information.

·       When the delivery partner arrives at the non-tied-up merchant outlet, they will inform the users of the price of the user items and ask them to confirm the purchase. Users must pay for the same in order to finish the transaction.
